Doug O’Neill, trainer of 2012 Kentucky Derby winner I’ll Have Another and current star miler Goldencents, said he will not appeal the ruling by the Breeders’ Cup that he would not be allowed to run horses in the Breeders’ Cup at Santa Anita Oct. 31-Nov. 1 because of a Class 2 medication violation in New York.

That means Goldencents, one of the leading contenders for either the Breeders’ Cup Dirt Mile or the Sprint, will have a different trainer if he runs, as is expected. Goldencents won last year’s Dirt Mile at Santa Anita.

The New York State Gaming Commission, in a settlement reached with O’Neill, on Thursday suspended the trainer for 45 days and fined him $10,000 after a horse he ran on June 2, 2013 at Belmont was determined to have the sedative Oxazepam in its system. The suspension was to start two days after the Breeders’ Cup, under the agreement.

The Breeders’ Cup on Friday issued a statement that under its Convicted Trainers Rule, O’Neill would not be allowed to participate as a trainer in its championship races — the first time the organization has invoked the rule. That policy, passed in 2010 and amended in 2012, says a trainer will not be allowed to pre-enter or enter a horse in the Breeders’ Cup if he or she in the preceding 12 months is found by any racing regulatory agency to have used or possessed any Class 1 or Class 2 substances carrying certain penalties.

The key is the timing of the regulatory ruling; O’Neill’s actual violation occurred well outside the 12-month time frame. The horse in question, Wind of Bosphorus, won a $35,000 claiming race.

O’Neill, in a statement issued by marketing representative Kelly Wietsma, said he did not administer the drug, which is classified as a Class 2 according to national standards, and is confident no one on his staff did either. But he said that he accepted responsibility as the trainer of record and came to the agreement with the gaming board because he did not want to be a distraction to the sport.

“I now realize that delaying the suspension so that I could participate in the Breeder’s Cup was a mistake,” O’Neill said in the statement. “Accordingly, after further reflection and prior to the Breeder’s Cup announcement that I could not participate, I made a request to the New York State Gaming Commission that my suspension begin on October 6, 2014 or as soon thereafter as is practical.

“I truly care about the horses under my care and the sport that we all love and do not wish for my suspension to do any more harm than it has already done."

I’ll Have Another’s Triple Crown bid, which ended when he was scratched the day before the Belmont Stakes with a career-ending injury, sparked scrutiny of O’Neill’s rules violations over the years.

O’Neill served a 45-day suspension (with 135 of the original 180 days stayed) that began shortly after the 2012 Triple Crown in a case dating to 2010 when one of his horses tested for a too-high level of TC02 in a horse racing at Del Mar.
